1. Scope

These Terms of Service apply to all orders you place through our online store at provatt.com with Provatt, and to your use of the website. By using the website or placing an order, you agree to these Terms, our Cancellation & Returns page, and our Privacy Policy.

2. Formation of Contract

The presentation of products in the online store does not constitute a binding offer. By clicking the order button at checkout you make a binding offer to purchase. The automatic acknowledgement of receipt does not constitute acceptance. A contract is formed when we send you an order confirmation or a shipping confirmation.

3. Eligibility

Purchases are intended for individuals aged 18 or older. If you are under 18, you may use the website only with the involvement of a parent or legal guardian. By placing an order you confirm that you have the legal capacity to enter into a binding agreement.

4. Use of the Website

You agree to use the website only for lawful purposes and not to interfere with its use by others. Any violation may result in suspension or termination of access.

5. Products and Availability

Our products are apparel. All products are available while stocks last. Descriptions, images, and visuals are provided for information only and may vary slightly from the delivered item, including in colour, fabric texture, and measurements, due to display settings and normal manufacturing tolerances. If an item becomes unavailable after you order, you will be notified and offered a full refund.

6. Prices and Payment

All prices are shown in the currency displayed in the store and include applicable taxes where required. Any shipping costs are shown separately before you complete your order. Price changes apply only to future orders and do not affect contracts already concluded. Available payment methods are listed on our Payment Options page. Depending on the payment method, the amount is charged when the contract is concluded or when the goods are shipped.

7. Delivery and Retention of Title

The estimated delivery time is shown for each product and on our Shipping & Delivery page. Delivered goods remain our property until payment has been received in full. Risk of loss passes to the customer on delivery.

8. Right to Cancel and Returns

Consumers have a statutory right to cancel within 14 days, plus a voluntary 30-day return. Details are on our Cancellation & Returns page. Apparel made to your specification or clearly personalised is non-returnable, except where defective or incorrectly supplied.

9. Warranty and Consumer Rights

Statutory rights regarding defective goods apply. Where you deal as a consumer, the applicable limitation period for defect claims on new goods is generally two years from receipt of the goods, or a longer period where your local law provides one. Nothing in these Terms limits your non-waivable statutory consumer rights.

10. Intellectual Property

All content on this website, in particular logos, images, text, and product designs, is protected by copyright and is the property of Provatt or its licensors. Use without our consent is not permitted.

11. User-Submitted Content

If you submit reviews, comments, or other content, you grant us a non-exclusive, royalty-free right to display that content on our website and in our communications. You retain your copyright. You confirm that your content does not infringe the rights of any third party.

12. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body, or health, under applicable product liability law, and to the extent of any guarantee we have given. For slight negligence, we are liable only for breach of a material contractual obligation, and such liability is limited to the foreseeable damage typical for this type of contract. All other liability is excluded. These limitations do not affect liability that cannot be excluded under applicable law.

13. Dispute Resolution

We are not obliged to and do not participate in dispute resolution proceedings before a consumer arbitration board.

14. Governing Law

These Terms and any contract formed under them are governed by the law applicable at our place of business, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Where you deal as a consumer, this choice of law does not deprive you of the protection of the mandatory consumer-protection provisions of your country of residence.

15. Changes to These Terms

The version of these Terms in force at the time of your order applies. We may update these Terms for future orders.
